Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using https://rachelthomasonwellbeing.com website.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access this service.

Use of services

You must be 18 years of age, or the age of majority in your county/province, territory or country, to use services provided by or become a member of the Rachel Thomason Wellbeing service.

By using any of these services, you will be asked to read and agree to the student waiver form. Agreement to the waiver and use of any service confirms your are accepting full responsibility for the risks associated with a physical practice and any potential injury that may result from it. You acknowledge that you have no mental or physical illnesses, impairments or injuries that will impact your ability to participate in the service or endanger yourself or others. If you suffer with any minor injuries, you agree to notify the instructor in advance.

Coaching and yoga services are not a replacement for professional medical mental or physical advice or treatment.

Payment terms

Details of yoga and coaching services are available on our website and shall be such prices as determined by Rachel Thomason Wellbeing on the web page.

Payments made for individual 1:1 sessions (yoga or coaching) are for the service stated and individual sessions must be booked and claimed within six months of purchase.

Payments made for programmes are valid for the intended programme only and cannot be transferred or redeemed at a later date.

Cancellations

If for any reason you are unable to attend 1:1 sessions booked individually or as part of a bundle, please give at least 48 hours’ notice directly to the coach/instructor to cancel or change your appointment. Less than 48 hours’ notice will incur the full session fee.

Online or in-person group yoga classes, or online yoga classes booked as part of a class pass must be cancelled more than 4 hours before the class commences. Cancellations with less than 4 hours’ notice and no-shows will be charged the full class fee either on the existing class pass or as a drop in fee.

In-person yoga workshops must be cancelled more than 24 hours before the class commences. Cancellations with less than 24 hours’ notice and no-shows will be charged the full class fee.

Subject to any statutory right of cancellation, payments for classes, class pass fees and monthly subscription fees are made non-refundable unless otherwise stated.

In the event of Rachel Thomason Wellbeing cancelling a Programme or 1:1 session, we will refund all deposits and payments they have paid. We cannot however compensate Members for any additional costs incurred outside of Rachel Thomason Wellbeing’s services. In the unlikely event that we must cancel a Programme due to force majeure (including but not limited to: weather, natural disaster, pandemic or political upheaval) we cannot guarantee a refund.

Membership subscription services

Billing Cycle: The membership fee and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership until your membership is cancelled. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.

Payment Methods: To use the Rachel Thomason Wellbeing service you must provide one or more Payment Methods. You can update your Payment Methods by using the links on your email notifications and reminders. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorise us to continue to charge the applicable Payment Method(s). You authorise us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.

Cancellation: You can cancel your membership at any time, and you will continue to have access to the service through to the end of your monthly billing period. We do not provide refunds or credits for any partial-month membership periods or unattended sessions. To cancel, email info@rachelthomasonwellbeing.com directly or use the links in your email notifications and reminders. If you cancel your membership, your online account will close at the end of your current billing period.

Changes to the Price and Subscription Plans: We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes or changes to your subscription plan will take effect following explicit notice to you.

Refunds: Payments are nonrefundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Rachel Thomason Wellbeing.

Rachel Thomason Wellbeing has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Rachel Thomason Wellbeing shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 (change this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
